Check the front brake rotor runout, the HD spec is .008" at the edge of the rim.
The caliper piston seal ring should pull the piston back far enough to release it,

but the rotor is responsible for pushing the pads back away from the rotor.
If you have an exceptionally straight rotor, they can remain in contact.
